It mightwith just as much propriety be urged, that, as a result of congresshad not hitherto used a particular means to executeany other given power, consequently it can perhaps not now do it. If, for example, congress had never provided a ship forthe navy, except by acquire, they could not now authorizeships to be built for a navy, or à converso. If they hadnot laid a tax on sure goods, it might not now be done. If that that they had never erected a custom house, or court house,they couldn’t now do it. Such a mode of reasoning wouldbe deemed by all people wholly indefensible. But it’s not admitted, that congress have notexercised this very power with reference to this very object.
